Thecertainlinkageexists betweentransnationaltransferandreturnofcultureproperty,which mainly refers to the issue for return of culture property robbed in wartime or stolen or obtained under ille-galtrade. Inthecurrentlegalenvironment,suchanissueisnotonlyaproblemofdomesticlaw,butalso that ofinternational law,andtherelevantlegal problems mainlyincludereturntothecountryas theowner ofcultureproperty,thesubstantial limitonreturningofcultureproperty,theprotectionofthethirdperson bonafideandtimelimitonprosecution. Itisnecessarytodealwiththeproblemforreturnofcultureprop-erty through international law system because the fact that domestic law cannot provide return of culture propertywithexpectableframework. Inthisway,thepaperwillfocusonmakingcommentofthefunctions anddefectsoftheconventionsas UNESCO1970 and UNIDROIT 1995 forthe protectionandreturnofcul-ture property and discuss the legal approaches for return of culture property.
