Abstract:External Benchmark refers to the importer taking countervailing measures on imported products, use prices of other countries than the surveyed country when calculating the subsidy benefit. This is one of the most important issues in US anti-dumping and countervailing measures against China. Relevant rules already existed in the US domestic legislation and they were referenced by the other countries and multilateral trade rules. Furthermore, External Benchmark has been used against China frequently and often accompanied by“Adverse Facts Available” rules to counteract some obstacles. External Benchmark is markedly different from the“surrogate price”, but adverse effects of External Benchmark to China will be more awful, which dilutes China’s vested achievement among “public body” and “double remedy”, and the problem will be more complicated. China should pay attention to this case as soon as possible and make full preparations.
