Group standards have adverse selection in their formulation and implementation. In general, the defect of element selection in standard setting is the main cause of adverse selection effect of social organization standard. By applying the principle of fairness, reasonableness and non-discrimination (FRAND), the EU regulates and restricts the licensing and application of“standard necessary patents”. China should learn from the experience of the European Union to solve the problem of the implementation of standard essential patents, improve the acceptability of patent value recognition, and scientifically select the technical index system of social organization standards, and solve the blocking points and pain points of the development of social organization standards by strengthening the openness of establishment of social organization standards, the diversification of their market subjects and patents or patent pools.
