Abstract:With the continuous decline in international trade and international investment, rising protectionism in the recent years, the phenomenon of anti-globalization is spreading globally. The United States and the European Union have introduced new legislation for national security review of foreign investment. China has also established a foreign investment security review system in the newly published PRC Foreign Investment Law. The current national security review of foreign investment in the United States and Europe have shown a tightening trend. For example, Foreign Investment Risk Review Modernization Act and the European Framework for Screening of Foreign Direct Investments were published in the United States and the European Union respectively. China should seize the opportunity of the transformation of the international economic and trade rule system to improve its foreign investment security review system. China should reflect on the shortcomings of the existing system and it is proposed to (i) introduce the special legislation on the foreign investment security review system as soon as possible; (ii) clarify the internal responsibilities of the joint meeting and establish reasonable decision-making mechanisms; (iii) unify review standards and set security review factors in line with the times.
