Abstract:China’s Hainan Free Trade Port is an independent arrangement of the Chinese Government on China’s territory under China’s sovereignty, and free trade is the core of Hainan Free Trade Port. Its nature belongs to the free zone inside the territory while outside the customs according to the World Customs Organization. It is subject to the compliance of WTO rules. The construction of international trade law rules of China’s free trade port construction includes domestic law and international law. In terms of domestic law, Hainan Free Trade Port Law should be formulated as soon as possible, while in terms of administrative regulations, relevant departments and Hainan Province are authorized by the National People’s Congress and its Standing Committee or the State Council. China should also fulfill its obligations under international treaties and agreements related to international trade. The international trade regulation of Hainan Free Trade Port is embodied in the opening up of the first line and the second line control. Before 2025, China will continue to maintain or establish special customs supervision areas, so as to facilitate customs supervision on international trade in goods, and open the free trade port to international services trade. From 2025 to 2035, the second phase of the construction of Hainan Free Trade Port will focus on building and improving relevant international service trade rules.
