Abstract:Applicant’s impecuniosity is the key criteria for the issue of the security for costs by the arbitration tribunal. Because the cause of the third party funding in the international arbitration is diversed, the arbitration tribunal should not issue a security for costs order for the only reason that applicant is funded by a third party funder. The arbitration tribunal shall further assess the cause of the third party funding. In a case where the applicant is funded by a third party funder due to the impecuniosity, it shall also assess whether the funder ameliorates the status of the impecuniosity. If the funder does not bear the obligation to pay for the adverse costs when the cases fail, or the funder has the right to terminate the funding at will, the arbitration tribunal shall issue the order of the security for costs in order to protect the interests of the other party.
