Abstract:RCEP is a FTA permitted and disciplined by the WTO. Its coverage on trade and services is extensive enough and not less favorable to other WTO members to satisfy the WTO rules. Some RCEP provisions invoke the WTO rules directly and some make further requirements. Without a general rule of conflict, RCEP relies on consultations on individual cases to solve the possible inconsistencies between RCEP and WTO provisions, leaving its efficiency into doubt.“TRIPS prevails”is a unique provision which is inconsistent with lex posterior in general international law. RCEP resembles CPTPP, both of which are inter se agreements in general international law.
