Abstract:In December 2021, 67 WTO members have completed negotiations on domestic regulation of trade in services. Based on the review of the negotiation experience, this paper creatively proposes that members should promote the open plurilateral agreement negotiations (OPAs) within the multilateral framework of WTO. The focus and difficulty of domestic regulation negotiation are pointed out, such as the negotiation should be promoted on four key issues: legal interpretation of domestic regulation of trade in services, necessity test, policy transparency and regulatory consistency, and the treatment of developing countries. China should adhere to the strategic concept of“following to win”in the open plurilateral negotiations on domestic regulation of trade in services. Besides, China should hold China’s position in the negotiations and develop China’s strength in trade in services.
