Abstract:As the Belt and Road Initiative progresses, China International Commercial Court (CICC) has emerged, but is still at an exploratory stage in certain aspects. The following improvements should be made to address the problems in litigation procedures, the composition and functions of the trial organization, and the recognition and enforcement of judgments. In terms of litigation procedures, the parties should be allowed to consensually choose English as the language of trial, foreign lawyers should be allowed to participate in litigation as attorneys in certain cases, and the appeal mechanism should be improved in different circumstances. The scope of selection of international commercial judges should be expanded, and the composition of the collegial panel should be reasonably structured. In terms of the recognition and enforcement of the judgments of CICC, China should participate more in international treaties, clarify the criteria of the principle of reciprocity, strengthen exchanges, actively enter into memorandums of understanding on cooperation with the Supreme Courts of other countries along the Belt and Road, and take comprehensive measures to facilitate the recognition and enforcement of the judgments of CICC.
