In order to make up for shortcomings in the enforcement of international settlement agreements and promote the wide application of international commercial mediation, the Singapore Mediation Convention provides for the cross-border direct enforcement mechanism of international settlement agreements on the basis of recognizing the effectiveness of international settlement agreements.Besides,the Convention limits the scope of the international settlement agreements based on the requirements of“international”,“commercial”, “mediation”and “formality”. In view of China’s urgent requirements for the domestic application of the Singapore Mediation Convention and to further improve China’s commercial mediation legal system, the issue of the scope of the directly enforceable settlement agreements has become crucial. Directly enforceable settlement agreements in China should cover domestic settlement agreements and international settlement agreements, and include settlement agreements resulting from institutional mediation and ad hoc mediation, while excluding settlement agreements that can be enforced as judgments or arbitrations.In addition, only settlement agreements that are generated to resolve commercial disputes and meet specific formal requirements can be included in the scope of directly enforceable settlement agreements.
